Asset protection and succession

Keep business risk away from family wealth

When the business, the property and the savings sit in the same name, one claim can reach all of it. We separate the risk, hold assets in the right place and plan how it all passes on.

Try it

Who could reach what you own?

Tell us whose name each asset is in. You will see straight away which ones a business claim could reach.

Choose who holds each asset

Your result appears here as you answer.

General information only. Personal guarantees, director penalties, family law and bankruptcy rules can reach assets held elsewhere, and protection depends on the facts, the timing and the law in your state.

How we protect it

Six ways we protect it

🧱

Separate trading from owning

The company that trades and takes the risk owns as little as possible. Property, equipment and cash sit elsewhere.

🌳

Family trusts with corporate trustees

Assets held for the family, not in anyone's personal name, with a company as trustee to limit liability.

🏢

Business property in the right place

Premises held in a separate entity and leased to the business at market rent. Some owners hold business premises in their SMSF; whether that suits you is a question for a licensed adviser, and we handle the tax and compliance side.

🔁

Profits moved out of harm's way

Surplus cash moved up regularly to a holding entity, done properly so Division 7A and tax rules are met.

📜

Succession and estate planning

Who controls the trusts after you, binding super nominations and buy-sell agreements, with your lawyer.

🛡️

Insurance gaps found

We point out where cover is missing and refer you to a licensed adviser. We don't sell insurance.

Succession

Succession starts years before you step back

  1. 5+ years out

    Get the structure ready

So the business can be sold or handed on without a big tax bill.

  2. 3 years out

    Decide the path

Family, staff buy-out or outside sale, and what each means for you.

  3. 1 year out

    Clean up and value

Tidy accounts, a valuation, and the small business CGT concessions checked.

  4. Handover

    Make it happen

Agreements, transfers, super contributions and the next owner set up.

Example, not a real client

A medical practice owner with the clinic building, the family home and investments all in personal names

Before

A claim against the practice could reach everything. No plan for who takes over the trusts or the practice.

After

Practice in a company, building in a separate entity leased back, investments in a family trust, and a written succession plan.

Same family, same assets, far less exposed

The assets moved to where they belong, with the CGT and stamp duty worked out, and roll-over relief used where available, before anything changed hands.

Questions

Common questions

Is asset protection legal?›

Yes, when it is done for genuine reasons and before any claim is on the horizon. Moving assets to defeat a known creditor can be reversed by a court, which is why timing matters.

Can my SMSF own my business premises?›

It can be allowed: business real property can be held by an SMSF and leased to your business at market rent, under strict rules. Whether it suits you is a question for a licensed financial adviser; we handle the tax and compliance side with them.

Does a family trust protect the family home?›

Sometimes, but the home has tax and land tax trade-offs when it is held in a trust. We weigh protection against tax before recommending anything.

What happens to the trust when I die?›

Control of a trust passes under the trust deed, not your will. We check who the appointor and trustee will be and coordinate with your lawyer.

Do you give insurance or financial product advice?›

No. We are not a financial services licensee. We point out gaps and refer you to licensed advisers.

How often should protection be reviewed?›

Every year, and whenever something big changes: a new business, a property purchase, a marriage, a separation or a death in the family.
